Sontag and Jasper Author Article for State Tax Notes
Bass, Berry & Sims Attorneys Mike Sontag and Steve Jasper have authored an article published in the May 18, 2009 edition of State Tax Notes. The article discusses a recent victory the attorneys received in the Tennessee Court of Appeals upholding a sales tax exemption for staff augmentation services, and the likely ramifications of that decision, including significant refund opportunities.
In TEKsystems, Inc. v. Farr, the Court affirmed a Chancery Court holding that software fabrication, installation, repair, or maintenance services performed by temporary employees provided of an IT staffing company are not subject to Tennessee sales tax if those services are performed under the direction and control of the client companies.
