Ross Booher is a Member in the firm's Litigation Practice Area.  Mr. Booher represents business and non-profit organizations in complex litigation, including matters involving: product liability, health care, antitrust law, contract disputes, business torts and Constitutional law.  Mr. Booher has significant experience conducting internal investigations and has served as trial counsel in more than 20 bench and jury cases.

Mr. Booher's litigation experience includes: 
  • Representation of a Fortune 50 consumer products manufacturer in an antitrust lawsuit alleging price discrimination and discriminatory promotional payments under the Robinson-Patman Act. Mr. Booher served on the prevailing trial team; a federal court jury in Nashville found in favor of the manufacturer on all claims. 
  • Representation of a government contractor in a bid protest action before the U.S. Court of Federal Claims. Mr. Booher served as lead counsel, obtaining a judgment resulting in his client retaining four government contracts worth an estimated $37 million. 
  • Representation of a heavy products manufacturer in an internal investigation related to alleged product defects and the potential need for a nationwide product recall. 
  • Representation of a Fortune 50 consumer products manufacturer in a federal action alleging violations of both the Robinson-Patman Act and Sherman Act. 
  • Representation of an international  manufacturer in an internal investigation related to potential regulatory and civil liability. 
  • Representation of a local private school, Brentwood Academy, in a federal civil rights action that has included successful briefing and oral argument before the United States Court of Appeals and the United States Supreme Court. Mr. Booher served as trial counsel in the successful jury trial of this case. 
  • Representation of a Fortune 50 consumer products manufacturer in a federal suit alleging intentional interference with contract and interference with business relationships.
  • Representation of medical device manufacturers in federal and state product liability suits. 
  • Representation of two international pharmaceutical companies in state court tort and breach of contract suits. 
  • Representation of a national architectural firm in a federal copyright infringement suit and multiple state court tort lawsuits. 
  • Representation of a small telecommunications company before the Tennessee Regulatory Authority regarding consumer complaints. 
  • Representation of a health care company as trial counsel in a contested arbitration regarding alleged healthcare fraud, breach of fiduciary duty and breach of an employment contract arising out of a corporate roll-up. 
  • Representation of a plaintiff family member in a lawsuit alleging wrongful death and wrongful denial of an insurance claim arising out of an auto accident; obtained a settlement in excess of $1 million for client. 
  • Representation of BellSouth Telecommunications, Inc. in multiple personal tort and property tort lawsuits.  
  • Representation of a large healthcare company in multiple wrongful death lawsuits arising out of a single mass casualty healthcare facility fire. 

Mr. Booher also has an active pro bono practice. He successfully represented a U.S. Navy officer in a civil rights and whistleblower matter .  In addition, Mr. Booher led a pro bono team of firm attorneys representing KIPP Academy Nashville, an award-winning Nashville public charter school for at-risk children.  Mr. Booher also currently serves as chair of KIPP's Board of Directors.  Mr. Booher received the Tennessee Bar Association's 2007-08 Harris A. Gilbert Access to Justice Award recognizing him as Tennessee's Pro Bono Attorney of the Year .

Prior to joining Bass, Berry & Sims PLC, Mr. Booher was an active-duty officer in the U.S. Navy Judge Advocate General's Corps. Mr. Booher served as a legal officer aboard the aircraft carrier USS George Washington, with NATO forces in Kosovo, as the legal advisor for a three warship Maritime Expeditionary Force sent to enforce U.N. sanctions against Iraq and as a military prosecutor based in Japan.  Mr. Booher's litigation experience as a judge advocate included representing the U.S. and individuals in administrative hearings, conducting investigations and prosecuting bench and jury trials.  Before becoming an attorney, Mr. Booher founded and served as president of Acorn Advertising, Inc., a Nashville-based marketing and advertising firm.

Mr. Booher graduated from the University of Tennessee College of Law summa cum laude and was awarded the Dean's Citation for Extraordinary Contributions to the College of Law.  He was a founder and chairman of the U.T. College of Law Speaker Series; a member of the U.T. National Moot Court Team, a Charles B. Higdon scholar, a member of the Tennessee Law Review and a clinic attorney for the indigent. Mr. Booher has been published in the Tennessee Law Review and The Chronicle of Higher Education.  He graduated from Vanderbilt University with a B.A. in political science after serving as president of the College of Arts and Science student body.
