Primary Care Providers Win Challenge of CMS Interpretation of Enhanced Payment Law

With the help and support of the Tennessee Medical Association, 21 Tennessee physicians of underserved communities joined together and retained Bass, Berry & Sims to file suit against the Centers for Medicare & Medicaid Services to stop improper collection efforts. As chair of the firm's Real Estate and Commercial Finance Practice Group, Cindy is a deal lawyer with nearly 30 years of experience representing banks, public and private companies and investors in a variety of financial transactions. She has a concentration in healthcare lending, with a focus on syndicated transactions and in real estate lending. In the last three years, Cindy has closed more than $1.1 billion in syndicated loan transactions, more than $1.8 billion in borrower side deals, and additional finance deals exceeding $1.1 billion.

With experience in syndicated senior credit facilities, mezzanine finance deals, asset based loans and commercial real estate financings, Cindy's practice involves:

  • Healthcare Finance – Partners with her healthcare colleagues to bring a depth of understanding and practical approach to finance matters uniquely effecting regulated healthcare companies.
  • Debt Finance – Advises on syndicated credit facility transactions, representing both the Administrative Agent and the borrower, bringing an understanding of what is important to both parties and why.
  • Real Estate Finance – Represents lenders in retail, multi-family and office real estate and construction loans

Cindy advises clients through all aspects of financing transactions, including negotiation of loan documents, due diligence and resolution of issues presented pre-closing, advising business clients regarding the impact of loan requirements or conditions, advising clients through the life of the loan as business opportunities or challenges arise, and working with lenders and companies on the downside of loans if they are not repaid as planned. She also collaborates with the Mergers & Acquisitions Practice Group on large corporate transactions that involve complex finance issues.

Formerly assistant general counsel at Bank of America, Cindy was responsible for supporting Tennessee, Georgia and the Northeast in all aspects of real estate lending and mezzanine financing.

Cindy has also assisted immigrants, tenants and young entrepreneurs in navigating legal requirements, contracts and various legal disputes on a pro bono basis.
