Primary Care Providers Win Challenge of CMS Interpretation of Enhanced Payment Law

With the help and support of the Tennessee Medical Association, 21 Tennessee physicians of underserved communities joined together and retained Bass, Berry & Sims to file suit against the Centers for Medicare & Medicaid Services to stop improper collection efforts. Our team, led by David King, was successful in halting efforts to recoup TennCare payments that were used legitimately to expand services in communities that needed them. Read more

Healthcare Transactions: Year in Review 2018Last year, CVS Health Corp. (NYSE: CVS) announced it would purchase health insurer Aetna Inc. For more than 30 years, Glenn Rose has represented clients in complex business disputes and insolvency situations, devoting roughly half of his practice to each area. He has guided numerous businesses through successful out-of-court restructurings and Chapter 11 reorganizations, including one of the largest individual Chapter 11 reorganizations in the country and a payment in full plan that preserved the ownerships interests of shareholders in a public company. In addition, Glenn has represented successfully numerous clients in a variety of complex business disputes.

Glenn has been recognized in Chambers USA for many years related to his litigation practice and is regarded as "'excellent and very bright' and commended by sources for his 'great judgment and demeanor.'" (from Chambers USA 2015) His practice includes:

  • Bankruptcy & Restructuring – Counseling debtors, creditors, committees, interested purchasers and other parties in bankruptcy cases and out-of-court transactions.
  • Business Litigation – Representing clients in disputes alleging breach of an acquisition agreement or other complex contract, breach of fiduciary duty or violation of securities laws; advising clients on insurance questions and litigates disputed coverage issues.
  • Healthcare Litigation – Defending lawsuits under the False Claims Act, conducting internal investigations and assisting clients with risk management issues.
  • Corporate Governance – Advising boards of directors in connection with insolvency situations, major corporate transactions and alleged violations of laws governing the operation of their business.

Prior to joining Bass, Berry & Sims, Glenn was a shareholder at Harwell Howard Hyne Gabbert & Manner, P.C.
