John Kelly is an experienced trial lawyer who represents companies and individuals in government investigations, prosecutions, and trials, and in qui tam or whistleblower litigation. John is the Managing Partner of the firm's Washington D.C. office. John has been recognized for his work and named one of Washington's Super Lawyers for white-collar criminal defense.

John began his career as a federal prosecutor with the Department of Justice (DOJ) where he held a number of leadership positions, including:

  • Assistant Chief for Healthcare Fraud, Criminal Division, Fraud Section.
  • Lead Prosecutor, Medicare Fraud Strike Force, Los Angeles, CA.
  • Chief of Staff and Deputy Director of the Executive Office for U.S. Attorneys, where he worked closely with senior leadership at the DOJ, HHS-OIG, FBI, DEA, and other federal agencies.

John's practice includes matters involving:

  • Healthcare Fraud and Abuse – Representing healthcare providers, life sciences companies and individuals in investigations and enforcement actions concerning the False Claims Act,  Anti-Kickback Statute, Stark Law, and the Food, Drug and Cosmetic Act.
  • FCPA and Anti-Corruption – Providing anti-corruption and Foreign Corrupt Practices Act (FCPA) counsel to clients in relation to internal investigations, pre-acquisition due diligence, compliance assessments, and enforcement actions.
  • Compliance Issues – Assisting clients across a variety of industries, including healthcare, with compliance assessments and internal investigations, and developing and implementing compliance policies and programs. 
  • Other Experience – Defending clients in matters involving allegations of insurance fraud, securities and accounting fraud, mail and wire fraud, bank fraud, and money laundering.  

John is a frequent speaker and author on topics related to healthcare fraud and abuse, white-collar criminal defense, compliance programs and issues, and the FCPA. He is frequently quoted in national media outlets on various compliance and government enforcement matters. His opinions have been published in articles by The Wall Street Journal, Reuters, Bloomberg News, Modern Healthcare, Law 360 and others. He has been invited to speak at conferences and seminars nationwide. In addition, John was a regular instructor at the DOJ's national training center lecturing on trial advocacy, criminal procedure, demonstrative evidence, ethics, and healthcare fraud. He was selected by the Justice Department to teach trial advocacy and criminal procedure to judges and prosecutors in Armenia and Azerbaijan.
