Primary Care Providers Win Challenge of CMS Interpretation of Enhanced Payment Law

With the help and support of the Tennessee Medical Association, 21 Tennessee physicians of underserved communities joined together and retained Bass, Berry & Sims to file suit against the Centers for Medicare & Medicaid Services to stop improper collection efforts. Our team, led by David King, was successful in halting efforts to recoup TennCare payments that were used legitimately to expand services in communities that needed them. Read more

Krista Cooper advises healthcare providers and companies on the transactional and operational aspects of their business. With both compliance and business objectives in mind, Krista helps clients identify the impact of joint ventures, mergers and acquisitions and other transactions. In addition, clients rely on her for regulatory and operational guidance. Recently, she assisted a major, publicly traded health system with the onboarding strategy for all new physician acquisitions. 

Krista's practice involves:

  • Operational Contracts – Drafting physician agreements, professional services agreements and other arrangements related to healthcare operations.
  • Transactions – Representing healthcare companies and investors in mergers, acquisitions, joint ventures and strategic partnerships.
  • Regulatory Matters – Advising on complex regulatory matters, including issues related to the Stark and Anti-Kickback Laws as well as state laws regarding fee splitting, corporate practice of medicine and licensure.
  • Compliance and Administrative Proceedings – Counseling clients with respect to Medicare and Medicaid audits and related appeals.
