Primary Care Providers Win Challenge of CMS Interpretation of Enhanced Payment Law

With the help and support of the Tennessee Medical Association, 21 Tennessee physicians of underserved communities joined together and retained Bass, Berry & Sims to file suit against the Centers for Medicare & Medicaid Services to stop improper collection efforts.   • Healthcare Litigation: Russ represents major healthcare companies in claims including healthcare IT disputes related to failed software implementation and contractual disputes.
  • Administrative and Regulatory Proceedings: Russ has successfully defended clients in numerous consumer protection investigations and civil investigative demands brought by various state attorneys general and other investigative or regulatory bodies.
  • Class Actions & Shareholder Suits: Russ regularly represents public and private corporations, non-profits and cooperative associations in class actions and shareholder derivate litigation in state and federal trial and appellate courts, as well as mediation and arbitration proceedings.

Before joining Bass, Berry & Sims, Russ served as an assistant Tennessee attorney general, where he represented the state in appellate litigation, legislative affairs, and litigation to defend and enforce an historic $4.8 billion settlement between the state and several leading tobacco manufacturers.

Russ formerly served in the United States Army and is currently a Lieutenant Colonel, Judge Advocate Generals Corps in the Tennessee Army National Guard, where he serves as Command Judge Advocate for the 230th Sustainment Brigade.
