Mary Beth Fortugno is a Member in the firm’s Healthcare Practice Group. Her practice focuses on transactions, operations, healthcare regulatory matters and investigations.

Healthcare: Mary Beth's experience includes counseling hospitals and other healthcare providers on operations and compliance matters, such as structuring transactions to comply with federal and state anti-kickback statutes and self-referral laws and providing guidance on general operational and contract compliance inquiries, including fraud and abuse, HIPAA, licensure, certification and other regulatory matters. 

Government Investigations: Mary Beth’s experience includes advising clients on the healthcare regulatory implications of various litigation matters involving, qui tam suits and whistle-blower retaliation claims. Mary Beth has extensive experience working with healthcare clients responding to governmental inquiries relating to Medicare and Medicaid fraud and the False Claims Act and has handled matters brought by the Department of Justice, the Office of Inspector General of the Department of Health and Human Services, various United States Attorneys Offices, and state Attorney General’s offices. She has also represented healthcare companies in overpayment disputes and advised clients regarding self-disclosure issues. 

Prior to joining the firm, Mary Beth worked for IASIS Healthcare, an acute care hospital company with 15 hospitals in six states. During her time with IASIS, Mary Beth served as operations counsel for the Florida and Texas markets where she provided regulatory advice and worked directly with the hospitals in connection with financial arrangements with referral sources. Mary Beth also oversaw healthcare litigation matters including responding to governmental investigations.

She is a member of the American Health Lawyers Association, American Bar Association, Tennessee Bar Association, Nashville Bar Association and a past member of Harry Phillips American Inn of Court.
