Matt focuses his practice in the area of complex commercial, securities and class action litigation and the representation of clients in connection with internal and governmental investigations.

Securities and Corporate: Matt has represented professional service firms, including public accounting and law firms, public companies, and officers and directors in securities and business-related litigation, including class actions, derivative actions and shareholder disputes before trial and appellate courts. Matt’s practice also has included representing corporate clients in connection with internal investigations and inquiries from federal regulatory agencies.

Healthcare: Matt has represented hospital ownership companies and physician practice groups in consumer and commercial litigation and False Claims Act qui tam actions. Matt also has represented healthcare clients in connection with internal investigations regarding potential regulatory and compliance issues and investigations conducted by the Office of Inspector General and United States Department of Justice.

Representative Matters include:
  • One of the lead attorneys representing Morgan Keegan & Co., Inc., and related individuals and entities in federal securities, ERISA and derivative multi-district litigation stemming from investment fund company losses in the wake of the credit crisis. 
  • Obtained dismissal with prejudice of IASIS Healthcare Corp. in False Claims Act litigation, United States ex rel. Frazier v. IASIS Healthcare Corp., 2008 U.S. Dist. LEXIS 78442 (D. Ariz. April 21, 2008). 
  • Successful representation of public companies in connection with actions to enjoin leveraged buyout transactions and related litigation. 
  • Successful representation of public accounting firms in In re Thomas & Betts Securities Litigation, No. 00-cv-02127 (W.D. Tenn.), In re Central Parking Securities Litigation, No. 3:03-cv-00546 (M.D. Tenn.), White v. KPMG LLP, No. 4:02-cv-00557 (E.D. Ark.), and In re Direct General Securities Litigation, No. 3:05-cv-00158 (M.D. Tenn.). 
  • Obtained dismissal on behalf of investment fund company directors in shareholder class action lawsuits: Riley v. Merrill Lynch, Pierce, Fenner & Smith, Inc., 168 F. Supp. 2d 1352 (M.D. Fla. 2001); In re Merrill Lynch & Co. Research Reports Securities Litigation, 273 F. Supp. 2d 351 (S.D.N.Y. 2003). 
  • Obtained dismissal in action brought to rescind sale of shares of private company, Chase Manhattan Bank v. CVE, Inc., 206 F. Supp. 2d 900 (M.D. Tenn. 2002). 
  • Represented clients in pro bono federal civil rights actions in both a federal jury trial and in an appeal before the United States Court of Appeals for the Sixth Circuit.

Matt also coordinates the firm’s participation in the pro bono representation of veterans of the United States Armed Forces in coordination with the National Veteran’s Legal Services Program’s Lawyers Serving Warriors project.

Prior to joining the firm, Matt served as a law clerk for Judge Michael S. Kanne of the United States Court of Appeals for the Seventh Circuit and Judge Royce C. Lamberth of the United States District Court for the District of Columbia.
