John Golwen is a Member in the firm's Litigation Practice Area.  He concentrates his practice in the area of business litigation.

Representative cases include the following:
  • Successfully represented state department of insurance in recouping multi-million dollar amount from parent company when a majority of assets of subsidiary insurance company was looted by new management after sale and redomestication of company to a foreign state.
  • Assisted in successfully defeating class certification in class action federal lawsuit by investors against major broker-dealer firm.
  • Assisted in obtaining dismissal of antitrust action against healthcare corporation brought by physician practice group and in obtaining an order affirming dismissal on appeal to Sixth Circuit Court of Appeals.
  • Defended in federal court as lead counsel for public corporation a post-merger lawsuit brought by members of  a former management team relating to employee benefits.
  • Successfully obtained jury verdict, as lead counsel, for defendant in Title VII action for sexual harassment.
  • Successfully defended, as lead counsel, Fortune 500 manufacturer of outdoor power equipment in federal lawsuit seeking to enjoin the client's director of engineering from working for the company in a corporate espionage and trade secrets action.
  • Assisted in obtaining substantial compensatory award as well as punitive damages in N.A.S.D. arbitration on behalf of major regional broker-dealer firm against group of former employees who resigned from fixed income sales department.
  • Successfully obtained multi-million dollar settlement on behalf of investment banking firms for fees owed to the investment banking firms as result of a merger of public companies.
  • Successfully obtained reversal of trial judge at Tennessee Court of Appeals as lead counsel on appeal of judgment for criminal and civil contempt against senior pastor and church leaders of one of Memphis' largest congregational churches.
  • Served as lead counsel in defending numerous predatory lending actions against lenders, mortgage companies and title companies in federal court.
  • Successfully handled administrative proceeding preventing the exclusion of a bank and certain officers from engaging in the mortgage banking business.

Before joining Bass, Berry & Sims, John was a member of Husch & Eppenberger, LLC in Memphis. He previously served as a law clerk for the Honorable Bailey Brown, United States Court of Appeals for the Sixth Circuit.

A native of Memphis, John graduated from The College of William and Mary in Virginia in 1986 with a B.A. degree in government.  In 1990, he received his law degree from the Washington & Lee University School of Law.  While in law school, John served as administrative editor of the Washington & Lee Law Review and served as the captain of the Mock Trial Team.

John is a member of the Memphis, Tennessee and Federal Bar Associations.  He is past-president of the Memphis and Mid-South Chapter of the Federal Bar Association.  He serves on the Central Board of Directors of the Boys & Girls Clubs of Greater Memphis; is past-president of the Phoenix Club, which raises funds for the Boys & Girls Clubs; is past-president of the University Club of Memphis, is a member of the Lawyers' Journal Club of Memphis, is past-finance chairman of the Shelby County Republican Party and serves on the Vestry of St. John's Episcopal Church in Memphis.
