Insurance and Managed Care

Our Insurance and Managed Care Practice counsels insurance companies, insurance holding companies, health maintenance organizations, preferred provider organizations, insurance brokers, insurance agencies and third party administrators on corporate and regulatory matters, including the development of insurance policies and provider contracts. Additionally, we represent insurance companies and HMOs in regulatory matters, legislative matters and administrative proceedings before the Tennessee Commissioner of Commerce and Insurance and in litigation. We have extensive and ongoing representations on behalf of clients involving matters with the Tennessee Department of Commerce and Insurance, including the Financial Affairs, Policy Analysis, Agent Licensing and Consumer Insurance Services sections of the Insurance Division, and the TennCare Oversight Division. We have a long record of success in resolving legal issues with the Commissioner through informal negotiations.

We also represent multi-state licensed insurance industry clients in matters involving insurance departments across the United States and are active participants in meetings and events held by the National Association of Insurance Commissioners. Members of our practice group are the only Tennessee representatives of the Federation of Regulatory Counsel, Inc., a professional association of insurance regulatory lawyers.

Our firm also advises several risk retention groups and purchasing groups, both domestic and offshore, as well as captive insurance companies. We have worked with managed care clients on existing insurance coverages and on future placements, including the alignment of insured-insurance company objectives on claims and coverage disputes. We have represented clients in negotiations of their workers’ compensation coverages and on premium disputes at renewal.

We have represented providers in disputes with payors, including disputes over the reasonableness of the fees charged by providers to payors. Our knowledge of the variety of reimbursement mechanisms and the entities involved in healthcare reimbursement enable us to act quickly and effectively on behalf of providers with issues in this area.
