Bankruptcy: Gene has handled all aspects of bankruptcy cases (representing debtors, secured and unsecured creditors, trustees, committees, and asset purchasers); various types of bankruptcy and commercial litigation at both the trial and appellate levels; and out-of-court workouts, restructurings and mediations. And, across all industries, in real estate transactions where bankruptcy remote entities are used, Gene often prepares opinions on substantive consolidation issues related to the transaction.
Commercial and Banking: Gene has represented parties in commercial litigation and mediation involving breach of contract, mechanics' liens and matters under the Uniform Commercial Code, including secured lending, warranties and enforcement of security interests.
Environmental and Mass Torts Litigation: A portion of Gene’s practice is devoted to environmental and mass tort litigation, especially benzene litigation in the petroleum manufacturing and distributing industry.

- Representing the post-petition secured lender in a manufacturer’s Chapter 11 case.
- Representing a nonprofit defending a Trustee’s claim to recover charitable donations.
- Representing the major landlord in a franchise restaurant Chapter 11 case.
- Representing a food distributor in a franchise restaurant Chapter 11 case.
- Representing a healthcare company purchasing assets out of a Chapter 11 case.
- Representing a petroleum manufacturer in benzene litigation in state court.
- Representing a coal mining company in its successful Chapter 11 reorganization.
- Representing an entertainment company in its successful Chapter 11 reorganization.
- Defending numerous businesses across a variety of industries against preference and fraudulent transfer actions in bankruptcy cases.
- Representing music industry artists in negotiating and drafting various business agreements.
Gene was an instructor of legal writing at the University of Kentucky College of Law for nine years, and he has lectured at continuing legal education seminars on bankruptcy, litigation discovery, collecting judgments, collecting delinquent debts and commercial lending.
