Primary Care Providers Win Challenge of CMS Interpretation of Enhanced Payment Law

With the help and support of the Tennessee Medical Association, 21 Tennessee physicians of underserved communities joined together and retained Bass, Berry & Sims to file suit against the Centers for Medicare & Medicaid Services to stop improper collection efforts. Department of Labor Investigation for Managed Care Company

Client Type: Public Company

We represented a publicly traded managed care company in a Department of Labor (DOL) audit of the potential misclassification of various employees as exempt under the Fair Labor Standards Act and of other individuals as independent contractors in its Texas market. We represented the company throughout the course of the audit and assisted the company with an ongoing self-audit regarding the same issues in other markets. We successfully argued the company's position with respect to significant classification issues, negotiated back-pay issues with respect to other positions, and were able to report to the DOL the voluntary resolution of similar issues in other markets.
