Represented a hospital in a retaliation lawsuit filed in Texas alleging our client and several other individual defendants violated the Texas Occupations Code by discharging him for complaining about certain hospital practices. The defendants collectively moved to dismiss the plaintiff’s claims under a new Texas procedural rule which the plaintiff argued was not intended to apply to a motion to dismiss based on a statute of limitations defense. The court rejected the plaintiff’s argument, and entered an order dismissing all claims.
