We represented a home improvement retailer when a current employee sued for associational discrimination. After the deposition, however, the employee resigned employment and agreed to drop the lawsuit, with our client only having to agree to waive discretionary costs. The employee recognized that, based on the evidence in the file, she could not make out her claim and in fact, her supervisor had been forgiving of her performance issues on several occasions, undermining her claim of retaliation as well.
