Primary Care Providers Win Challenge of CMS Interpretation of Enhanced Payment Law

With the help and support of the Tennessee Medical Association, 21 Tennessee physicians of underserved communities joined together and retained Bass, Berry & Sims to file suit against the Centers for Medicare & Medicaid Services to stop improper collection efforts. Bass, Berry & Sims served as lead counsel to AxelaCare Health Solutions LLC – a subsidiary of United Health Group – in its efforts to obtain a Certificate of Need (CON) to initiate homecare operations in 34 counties in and around metropolitan Knoxville, Tennessee. The project received wide support – including from Wellmont Medical Associates – and was unanimously approved by state regulators. The addition of AxelaCare's services in East Tennessee will make highly specialized immune globulin infusion therapy available at home to seriously ill patients suffering from very rare cancers and chronic immunological and neurological disorders. Researchers across the United States use data collected via AxelaCare's proprietary patient care technology in a wide variety of clinical research.

AxelaCare specializes in specialty infusion therapy homecare services. Its nursing specialists have performed more than 44,000 infusion therapy sessions in recent years. AxelaCare has received the Joint Commission's "Gold Seal" of approval and is recognized for meeting the highest clinical standards in the industry.
