Elizabeth focuses her practice exclusively on healthcare law. She counsels healthcare providers and other healthcare industry clients on the changing regulatory landscape within the healthcare industry.

HIPAA privacy and security rule compliance: Elizabeth counsels providers, health plans and business associates on the requirements of the HIPAA privacy and security rules, as well as state and other requirements related to the confidentiality and security of health-related information, responding to data breaches and preventing identity theft. Among other things, Elizabeth advises clients on properly responding to privacy or security incidents, implementing necessary policies and training employees. She also advises employers and their group health plans on how to comply with HIPAA.

Contracting, regulatory and operational matters: Elizabeth assists clients on a daily basis with healthcare operations and regulatory issues, including Stark Law and other fraud and abuse compliance, responding to record requests, parent/minor consent to treatment issues and EMTALA compliance. Elizabeth has extensive experience drafting and negotiating healthcare operational agreements such as professional service agreements, recruiting agreements, medical director agreements and provider employment agreements.

Compliance: Elizabeth frequently counsels providers on developing and implementing compliance programs and related policies. She also helps providers respond to compliance issues, such as handling suspected or identified overpayments.

Joint venture and management relationships: Elizabeth works with clients on structuring joint ventures and management relationships in compliance with federal and state law requirements. Her experience includes handing regulatory issues raised by physician ownerships of hospitals and structuring unit or service line management arrangements between hospitals and management companies.
