David is assistant practice leader for the firm’s Financial Products & Broker-Dealer Group, focusing on the areas of professional liability in the securities and healthcare industries, product liability and mass torts. He also counsels clients on risk management and healthcare operations issues.

Broker-Dealer and Financial Products: David represents broker-dealers in FINRA arbitrations.

Healthcare/Mass Torts: David has served as lead counsel in litigation involving multi-fatality nursing home fires in Tennessee and Virginia. He also serves as lead counsel in professional liability actions involving wrongful death and catastrophic injury claims for a major academic center, national nursing home company and one of the largest single specialty medical groups in the Southeastern United States.

Products Liability: David has served as litigation counsel in product liability actions involving various products such as automobiles, trucks, food, drugs, pesticides, medical devices and manufacturing equipment.

Representative Matters include:
  • Mutual Fund litigation – David is currently involved in the management and defense of a broker-dealer in a significant number of arbitration claims in several states arising out of the credit crisis.
  • Multi-fatality nursing home fire – Recently, David served as lead co-counsel for a nursing home company in consolidated litigation involving a multi-fatality nursing home fire, which resulted in the successful resolution of 30 of the 32 cases within one year from the date of the fire and the remaining cases within three years. The mediator, in his report to the court, described this process as “the most successful mass tort mediation in the jurisprudence of Tennessee.”
  • Vanderbilt University Medical Center – David recently represented Vanderbilt in two catastrophic injury claims involving minors. One involved the delayed diagnosis of leukemia and the other involved the alleged mismanagement of a patient suffering from seizures.
  • Circuit City Stores, Inc. – David recently represented Circuit City in a significant multiple injury case involving the installation of after-market automotive components which allegedly disabled a vehicle’s air bag system.

David played on the Varsity Golf Team at the University of Tennessee. He is married and has two children.
