David is co-leader of the Products, Torts and Insurance Litigation Group and assistant leader of the Broker-Dealer and Financial Products Litigation Group. He has served as a litigation representative on the firm’s Executive Committee and is a firm representative in The Network of Trial Law Firms.

David has significant experience and success as a trial lawyer in federal and state court, and in arbitration and mediation proceedings. Over the course of his 26 year career, David’s practice has focused on healthcare, products liability, torts, and insurance litigation. In the wake of the financial crisis in recent years, David has expanded his practice to include broker-dealer and financial products litigation.

Healthcare: David serves as lead counsel in healthcare liability actions involving wrongful death and catastrophic injury claims for a major academic medical center, national nursing home company and one of the largest single specialty medical groups in the Southeastern United States. He also has significant experience representing hospitals in peer review, medical staff and credentialing matters.

Representative cases include:
  • In re: NHC/Nashville - Lead counsel in consolidated litigation involving a high publicity multi-fatality nursing home fire involving 16 deaths, which resulted in the successful resolution of 30 of the 32 cases within one year from the date of the fire. 
  • Olerud v. Vanderbilt University – Lead counsel in defense of wrongful death claim arising out of alleged delay in diagnosis of a minor patient.
  • Smith v. Anesthesia Medical Group – Lead counsel in defense of catastrophic injury claim arising out of intraoperative complications.

Products, Torts and Insurance: David has defended a significant number of product liability actions involving various products such as automobiles, trucks, food, drugs, pesticides, medical devices and manufacturing equipment. He also has significant experience defending other types of cases involving fatalities and catastrophic injuries. In his insurance practice, David has represented various entities in insurance coverage disputes, and is currently representing a large hospital company against a managed care company for several million dollars of unpaid claims.

Representative cases include:
  • Rephan v. Circuit City Stores, Inc. – Lead counsel in action involving allegedly defective air bag, resulting in significant personal injuries.
  • Ray v. McGee – Lead counsel in defense of wrongful death action involving off-label use of prescription medication.
  • Greyhound Bus Lines v. Rogers Group, Inc. – Defense of road construction company in multi-injury bus accident case, involving significant media exposure and NTSB investigation.

Broker-Dealer and Financial Products: David has served as lead counsel in a number of broker-dealer arbitrations stemming from the financial crisis, several of which involve multiple claimants in matters involving financial products.

Representative matters include:
  • Morgan Keegan Bond Fund Litigation – David has led a team of attorneys and paralegals in the Nashville and Knoxville offices handling a significant number of arbitrations involving the RMK bond funds, while serving as lead counsel in dozens of arbitrations in several states.
  • Sun Life Variable Annuity Litigation – David serves as lead counsel in several claims arising out of losses from a variable annuity product.

David attended the University of Tennessee (B.S. 1982, J.D. 2005), where he played on the varsity golf team. He is married and has two children.
