David represents commercial, real estate and financial services clients in administrative proceedings, state and federal court.

Commercial: David has represented numerous companies in complex commercial disputes involving a broad range of claims, including breach of contract or fiduciary duty, misrepresentation and other business-related matters. David has significant e-discovery experience and has managed e-discovery review teams.

Securities and Corporate: David has assisted in the defense of putative class actions related to the subprime mortgage crisis. He has significant experience in jurisdictional and dispositive motions related to securities lawsuits.

Administrative and Regulatory Proceedings: David has served as trial counsel on behalf of telecommunications and utility companies before the Tennessee Regulatory Authority.

Real Estate: David has experience at the trial and appellate level representing developers and local governments in litigation regarding zoning and land use matters. In addition, David also has real estate litigation experience at the trial and appellate level concerning deeds of trust, mortgages, boundary disputes, leases and sales contracts.

Environmental and Mass Torts: David has experience with environmental litigation, transactional and regulatory matters concerning air pollution, water pollution, hazardous waste and toxic materials, including advising buyers, sellers and lenders on environmental issues in real estate and corporate transactions.

Representative Matters include:
  • Assisted in the representation of Morgan Keegan & Co., Inc., and related individuals and entities, in federal securities multi-district litigation stemming from investment fund company losses in the wake of the credit crisis.
  • Assisted developer in obtaining multi-million dollar arbitration award in a dispute over development of a New England shopping center.
  • Assisted an apartment developer in obtaining a multi-million dollar arbitration award against an engineering firm that conducted a deficient Phase I environmental assessment.

David serves on the firm’s Pro Bono Committee and manages the BBS Pro Bono Adoption Initiative. David and his wife, Katy, enjoy cooking and traveling.
