David represents commercial, real estate and financial services clients in administrative proceedings, state and federal court.

Commercial: David has represented numerous companies in complex commercial disputes involving a broad range of claims, including breach of contract or fiduciary duty, misrepresentation and other business-related matters. David has significant e-discovery experience and has managed e-discovery review teams.

Securities and Corporate: David has assisted in the defense of putative class actions related to the subprime mortgage crisis. He has significant experience in jurisdictional and dispositive motions related to securities lawsuits.

Administrative and Regulatory Proceedings: David has served as trial counsel on behalf of telecommunications and utility companies in contested cases before the Tennessee Regulatory Authority. David also regularly represents regulated public utitities in a variety of matters before the TRA.

Real Estate: David has experience at the trial and appellate level representing developers, individuals and local governments in litigation regarding real property, zoning and land use matters. David has experience working with major wireless carriers and tower operators in the telecommunications industry to address site acquisition and zoning and land use issues. David also has real estate litigation experience at the trial and appellate level concerning deeds of trust, mortgages, boundary disputes, leases and sales contracts.

Representative Matters include:
  • Assisted in the representation of Morgan Keegan & Co., Inc., and related individuals and entities, in federal securities multi-district litigation stemming from investment fund company losses in the wake of the credit crisis.
  • Assisted developer in obtaining multi-million dollar arbitration award in a dispute over development of a New England shopping center.
  • Assisted public utility client in achieving a favorable multi-million dollar rate increase.

David serves on the firm’s Pro Bono Committee and manages the BBS Pro Bono Adoption Initiative. David and his wife, Katy, enjoy cooking and traveling.
