Brian Iverson's practice focuses on commercial litigation, with a special emphasis on litigation involving financial institutions.

Financial Products and Broker-Dealer: Brian has represented broker-dealers in professional liability claims before the Financial Industry Regulatory Authority. He has also defended broker-dealers in federal and state securities law claims.

Financial Institutions: Brian has represented banks in loan disputes, contract disputes, tort claims and consumer protection claims.

Commercial: Brian has represented both privately-held and publicly-traded companies in contract disputes, product liability claims, and other tort claims.

Dodd-Frank Act: Brian has studied extensively the recently-enacted Dodd-Frank Wall Street Reform and Consumer Protection Act and has summarized many of the provisions most relevant to financial institutions.

Representative Matters include:
  • Bond Fund litigation – Brian was involved in successfully resolving numerous arbitrations brought against a broker-dealer relating to a series of bond funds that declined significantly in value during the economic meltdown.
  • Securities Fraud litigation – Brian was involved in successfully mediating six separate lawsuits against a broker-dealer related to a broker's outside business activities.
  • International Commercial Arbitration - Brian was involved in advising Canadian counsel on liability and insurance issues under Tennessee law for an international commercial arbitration involving a contract dispute between a Tennessee manufacturer and a Taiwanese supplier.
  • Fraudulent Account Activity litigation - Brian was involved in resolving claims against a bank related to an unknown third party's use of malware to fraudulently transfer money out of a commercial bank account. Prior to the resolution of the dispute, the bank obtained partial summary judgment on loans it extended to cover the customer's losses.
  • Contract Logistics litigation - Brian is currently involved in representing a third-party logistics provider in a multi-party commercial dispute.
  • Overdraft Fee litigation - Brian is currently involved in representing a bank in a putative class action related to the bank's overdraft fee practices. The bank recently won a motion to dismiss tort claims from the complaint.

In law school, Brian was a successful competitor in numerous trial and appellate advocacy competitions. He was also a member of the Pepperdine Law Review and served as a Teaching Assistant for Legal Research and Writing. Brian enjoys running and regularly participates in community races. He volunteers his time to provide childcare at the YWCA Weaver Domestic Violence Center. He is also an avid fan of the St. Louis Cardinals.
