Bass, Berry & Sims PLC Among Benchmark Litigation’s Highly Recommended Tennessee Firms


Nashville, Tenn., October 22, 2009 – For the third year in a row, Bass, Berry & Sims PLC has been ranked among Tennessee’s “Highly Recommended Firms” by Benchmark Litigation, a guide to America's leading business litigation firms and attorneys.  Additionally, Benchmark Litigation cites seven of the firm’s trial attorneys as either “Local Litigation Stars” or “Future Stars.”  Bass, Berry & Sims PLC has more attorneys cited on these combined lists than any law firm in Tennessee.

H. Lee Barfield, Michael Dagley, Wallace Dietz, Samuel Felker, R. Dale Grimes and Overton Thompson are listed as “Local Litigation Stars.”  Britt Latham and Brant Phillips are listed as “Future Stars.”  All are litigation attorneys and firm members.

Barfield is described in the publication as an attorney that competitors consider a “standout” in the firm. He has substantial experience in litigating both jury and non-jury civil cases in state and federal court, including healthcare cases, business disputes, insurance litigation, class actions, and constitutional law claims. He has also been involved in litigation over the valuation of closely held corporations.

Dagley, Latham and Phillips are representing defendants in more than 15 class action, derivative and ERISA cases related to investment losses involving asset-backed securities.  This litigation is among the largest group of “subprime crisis” cases in the United States.

Dietz won a complete jury verdict for TeleCheck Inc. following a two week federal court jury trial involving alleged violations of the Fair Credit Reporting Act.  He has served as lead counsel for several companies in shareholder class action litigation, including Gaylord Entertainment Company, PFG and others.  He recently served as lead counsel for the former Board Directors of Dollar General in a shareholder class action challenging the company’s $7.3 billion going private transaction with KKR.

Felker represents numerous Fortune 500 manufacturers of pharmaceuticals, medical devices, construction supplies and other products.  He also is a trained mediator and is currently defending an investment company client in numerous broker-dealer arbitrations throughout the country. 

Grimes represents a Fortune 50 consumer products company in two class actions, and previously represented that company in a complex Robinson-Patman Act case that resulted in a jury verdict for the client.  He also represents a major automobile manufacturer in multidistrict consumer class action litigation.  He has represented numerous national companies in antitrust litigation.  He also represents a number of regulated utilities before the State utility commission.

Latham, Phillips and Thompson served as lead counsel to Nashville-based Genesco Inc. in its high-profile breach of contract lawsuit against The Finish Line in 2007, in which the court issued a landmark ruling that prohibited The Finish Line from backing out of the parties’ $1.6 billion merger agreement.  The case ultimately settled for a substantial sum on the eve of a related solvency proceeding in New York.
